The Small Business Innovation and Economic Security Act Extends America’s Seed Fund Through 2031

On March 17, 2026, the U.S. House of Representatives passed S. 3971 in a bipartisan 345-41 vote, sending the Small Business Innovation and Economic Security Act to the President’s desk. The legislation, led by Senator Joni Ernst and Senator Ed Markey, reauthorizes the Small Business Innovation Research and Small Business Technology Transfer programs through September 30, 2031, after a five-month lapse that froze nearly $6 billion in annual funding to more than 4,000 companies. The Information Technology and Innovation Foundation noted SBIR/STTR accounts for just 3.2 percent of federal extramural R&D spending yet has generated over 70,000 patents, 700 public companies, and $40 billion in total awards since 1982.

Strategic Breakthrough Awards Open a $30 Million Door for Certified Small Businesses

For ISBEE-certified, Veteran-Owned, Service-Disabled Veteran-Owned, Women-Owned, HUBZone, and 8(a) firms, the new Strategic Breakthrough Awards change the game. Agencies with more than $100 million in annual SBIR obligations can now award up to $30 million per company through milestone-driven contracts capped at 48 months, targeting the transition from prototype to deployment. The National Venture Capital Association called the provision a “much-needed pathway to commercialization” that helps firms bridge the valley of death between research and fielded capability. The Navy alone awarded $1.5 billion in Phase III obligations to over 150 programs in 2024, signaling massive demand for small business innovation across defense, health care, and technology sectors.

What This Means for Set-Aside Companies in Government Contracting

The act mandates enhanced training for contracting officers on Phase III commercialization, strengthens foreign ownership due diligence, and requires agencies to cap proposal submissions to reduce barriers for new entrants. For Native owned small businesses, Veteran-Owned firms, Women-Owned enterprises, and every socioeconomic set-aside category pursuing federal contracts in health care, defense, energy, and homeland security, these reforms improve access to early-stage capital and accelerate the path from concept to contract! The NSBA and SBTC urged the President to sign the bill immediately, calling it a victory for the 4,000-plus companies that innovate, create jobs, and harness vital technology for the federal government each year.
